A former Google software engineer, Linwei Ding, also known as Leon Ding, has been indicted in California for allegedly stealing trade secrets related to artificial intelligence from Google’s parent company, Alphabet. Ding’s indictment comes just over a year after the Biden administration established an interagency Disruptive Technology Strike Force to prevent advanced technology from being acquired by countries like China and Russia, which could pose a threat to national security.

U.S. Attorney General Merrick Garland emphasized the Justice Department’s stance against trade secret theft, stating, ‘The Justice Department just will not tolerate the theft of our trade secrets and intelligence.’

According to the indictment, Ding allegedly stole detailed information concerning Google’s hardware infrastructure and software platform used in supercomputing data centers to train large AI models through machine learning. This stolen information included specifics about chips, systems, and software crucial for a supercomputer capable of executing cutting-edge machine learning and AI technology.

Some of the allegedly stolen chip blueprints were designed by Google to gain a competitive advantage over cloud computing rivals such as Amazon.com and Microsoft, ultimately reducing reliance on Nvidia chips.

Hired by Google in 2019, Ding reportedly began stealing trade secrets three years later while being courted for the position of chief technology officer at a Chinese tech company. By May 2023, Ding had allegedly uploaded over 500 confidential files. The indictment revealed that Ding founded his own technology company that same month and shared a document in a chat group.

Google became wary of Ding’s activities in December 2023, prompting them to seize his laptop on January 4, 2024, just a day prior to Ding’s intended resignation. Google spokesperson Jose Castaneda affirmed the company’s stringent measures in safeguarding confidential commercial information and trade secrets, noting that following an investigation, they uncovered numerous instances of document theft by the employee, leading to prompt referral of the case to law enforcement.

If convicted, Ding could face up to 10 years in prison and a $250,000 fine for each criminal count.
